Contract Agreement

I hereby give permission for my child, _________________________, to participate in the Stevens High School American History Group (hereafter also known as SHSAHG/APUSH) three-day excursion to the Little Bighorn Battlefield National Monument in Montana and additional sites in Wyoming. In sole consideration of the opportunity for my child, _________________________, to participate in the SHSAHG/APUSH excursion, I hereby for myself and my child, my heirs, personal representatives, executors, administrators, and assigns, waive, release, and covenant not to sue for any and all claims for injuries, damages, costs, expenses, loss of service, loss of consortium, actions and causes of action, including each and every right or payment for damages I or my child may have hereafter against Scott Tubbs; other teachers, parents, and adults acting as drivers, chaperones, supervisors, and as individuals acting in other capacities; hosts and facility owners; and any other representatives or agents of the SHSAHG/APUSH for any and all injuries, damages, costs, expenses, loss of service, and loss of consortium that may be suffered, directly or indirectly, as a result of any activity which involves the SHSAHG/APUSH to include traveling to, participating in, or returning from the Little Bighorn Battlefield National Monument, regardless of method of transportation.

I hereby consent to any medical services that may be required while my child is under the supervision of Scott Tubbs, while involved with the SHSAHG/APUSH, and hereby appoint Scott Tubbs to act on my behalf in securing any necessary medical treatment, including hospitalization and the use of anesthesia, for my child, _________________________.

I attest that I have been encouraged by Scott Tubbs to ensure that I have adequate insurance to cover my child for any injuries, damages, or losses my child may sustain as a result of my child's participation with the SHSAHG/APUSH; and that no claims will be made against Scott Tubbs and other representatives or agents of the SHSAHG/APUSH relative to the aforementioned.

I further attest that I have been encouraged by Scott Tubbs to become familiar with this activity by consulting with Scott Tubbs about supervision and safety of my child; that my child is participating in this activity with my consent and approval; and that no claims will be made against Scott Tubbs and other representatives or agents of the SHSAHG/APUSH relative to the aforementioned.

I understand that this Contract Agreement constitutes a waiver, release, and covenant not to sue and contains the entire agreement between the parties hereto; and that the terms of this waiver, release, and covenant not to sue are contractual and not a mere recital.

I confirm that I have carefully read the foregoing Contract Agreement, know the contents thereof, and have signed the same as my own free act.
